“Can’t block internet indefinitely,” says SC; orders J&K govt to review all restrictions in 7 days

The Kashmir valley has been under communication curbs for the last 160 days since the abrogation of Article 370 of the Constitution.

Supreme Court on Friday, while hearing bunch of petitions against the internet and communication blackout imposed in Jammu and Kashmir, said that such suspensions can only be for a limited time period and is subject to judicial review

“Freedom of speech and expression includes right to internet within Article 19 of the Constitution. So the restrictions on internet has to follow the principles of proportionality under Article 19(2),” the judgment read, given by a three-judge bench comprising Justices R Subhash Reddy and BR Gavai, headed by Justice NV Ramana.

The Kashmir valley has been under communication curbs for the last 160 days since the abrogation of Article 370 of the Constitution.

Apex Court ordered the Jammu and Kashmir administration to review all restrictive orders within a week. All orders are also asked to be also put in public domain which can then be challenged in a court of law. These orders can be challenged in the Jammu and Kashmir High Court and Supreme Court.
