Jharkhand High Court dismisses Rahul Gandhi’s plea in case involving objectionable remarks against Amit Shah

The Jharkhand High Court rejected a petition seeking to end the case regarding Rahul Gandhi’s statement against Amit Shah, then the BJP President, in 2018. The civil court had issued summons in the deposition case.

BJP leader Navin Jha filed a complaint against Rahul Gandhi alleging that during the AICC Plenary Sessions held on March 18, 2018, Rahul Gandhi made a speech against the BJP and referred to Amit Shah as a murder suspect.

The Court was asked whether the statements made by Gandhi would give rise to a cause of action for the opposing party no, 2 to file the present complaint case since the complaint was not brought against him personally; whether the foregoing statement will prima facie constitute defamation?
