SC dismisses students plea seeking relief in regard to compartment exams with liberty to challenge CBSE notification

Supreme Court, SC has rejected students plea seeking direction to Central Board of Secondary Education, to not force CBSE 10th, 12th students to appear for the compartment exams 2020 along with the liberty to challenge CBSE notification.

All India Students Association, AISA had demanded to cancel the CBSE Compartment Exams 2020, scheduled to commence in the month of September and wrote a letter to the Education Minister Ramesh Pokhriyal Nishank and education ministers of all states appealing them not to hold the compartment exams during an uncertain pandemic situation.

The student union, which has been constantly opposing the holding of any exam amid the pandemic, wrote letters on behalf of students who failed in a subject with a margin of one to seven marks.

Earlier, CBSE had stated that the compartment exams were necessary for the future of the students.

Today, a bench of Justices AM Khanwilkar, Dinesh Maheshwari Sanjiv Khanna heard the case. The bench said, “We have already decided the plea and the CBSE has given reasons in its notification.”

The bench also told that CBSE had already mentioned the reasons in the notification for compartment exams released. It asked the petitioner to file a plea challenging the notification.

The students association also asked the Board to consider the grace marks or marks based on the Internal assessment and deem them as ‘Passed’ in their Board exam.

Letter reads: “Over 2.2 lakh students including students of your state found themselves in the Compartment category by 1-7 marks. The students demand the cancellation of the Compartment exam for the following reasons.”

In the letter, AISA mentioned that due to the rise of COVID19 cases and state of uncertainty, students are dealing with a lot of mental health issues, stress, and even lacking in resources which are required to take the exam, that is why they want the cancellation of the compartment exams.
