Supreme Court on Tuesday, June 11 questioned journalist Prashant Kanojia’ arrest for “defaming” UP Chief Minister Yogi Adityanath.
The Supreme Court ordered the Uttar Pradesh government to immediately release journalist Prashant Kanojia. The highest court said, Kanojia is ‘not a murderer’.
“Liberty of citizen is sacrosanct and non-negotiable. It is guaranteed by the Constitution and it cannot be infringed,” Justice Indira Banerjee said, slamming UP police for the arrest.
The apex court also slammed the Magistrate, who had sent Kanojia for 11 days judicial remand. During hearing, Justice Banerjee said that, “Even we take in a lot from social media, but does that mean incarceration? Show your magnanimity.”
Justice Indira Banerjee: A persons liberty is being curtailed. Opinions may vary and perhaps such things should not have been posted, but arrest? Under what provision has he been arrested?
Banerjee: Section 505 of IPC
