What changes for Jammu & Kashmir after revocation of Article 370?

The provisions of the Constitution which are applicable to other states are not applicable to the state.

Bharatiya Janata Party-led government on Monday, August 5 announced the abolition of Article 370 and 35A of the Indian Constitution which granted special status to Jammu and Kashmir. Moreover, it was also announced that the state Jammu & Kashmir would now be a Union Territory (UT) with a Legislative Assembly while Ladakh would be a UT without a Legislative Assembly.

The provisions under Article 370 and 35A assured that people of J&K would draft their own constitution through their own constituent Assembly. Further, except for defence, foreign affairs and communications, Parliament would need the state government’s concurrence for applying all other laws to J&K. In other words, the provisions of the Constitution which are applicable to other states are not applicable to the state.

Indian citizens from other states can buy land or property in J&K

As it stands now, the discriminatory provisions that deprived the non-Jammu and Kashmir citizens of the right to buy property in the state stand scrapped. Other Indian citizens can now buy any kind of property in Jammu and Kashmir.

No more dual citizenship a norm. The citizenship of the region would now have only the Indian citizenship with them. With Article 370, they had both the Indian as well as the J&K citizenship.

With Article 370, minorities enjoyed no reservation but after the scrapping of Article 370 they would be eligible for reservation.

The region would cease to have a separate flag and the only tricolour would be the only flag.

The Right to Information Act and the Right to Education Act will become valid in J&K.

Legislative Assembly duration which was earlier 6 years would now be 5 years in consonance.

Had J&K woman married outside she would have lost her state citizenship, but now there will be no concept of dual citizenship.
