The Supreme Court has begun reading out the historic triple talaq ruling. The five-judge Constitution bench comprises Chief Justice Jagdish Singh Khehar, Justice Kurian Joseph, Justice Rohinton Fali Nariman, Justice Uday Umesh Lalit and Justice S Abdul Nazeer.

During the hearing, the apex court had clarified that it may not deliberate upon the issue of polygamy and said it would only examine whether triple talaq was part of an “enforceable” fundamental right to practice religion by the Muslims.

The petitions included five separate writ petitions filed by Muslim women challenging the practice of triple talaq prevalent in the community and terming it “unconstitutional”. In last few years, as claimed, some of the Muslim women have been given talaq over Skype, Whatsapp, by phone or even a text message. During the hearing, the apex court had observed that triple talaq is “worst” and “not a desirable” form of dissolution of marriage.
