Imran Khan Gets October 28 Exit Deadline: Imran Khan, Bollywood actor & nephew of Aamir Khan, is reportedly told to leave the country by October 28, 2026, over participating in protests for the resignation of Chief Election Commissioner (CEC) Gyanesh Kumar in Mumbai.

Following that, an FRRO notice was also released which came out due to complaints from BJP leader Kirit Somaiya. She argued about his involvement in political demonstrations while he is claimed to have US citizenship and an OCI card.

“The FRRO has taken the action and a notice was served to the actor Imran Khan, who is [in India] on an OCI card. The actor nephew of Bollywood star Amir Khan stays in Khar and was served the notice,” said a Mumbai Police official.

Why Has Imran Khan Been Asked To Leave India?

On October 10, Imran Khan attended a protest being held in Mumbai’s August Kranti Maidan demanding the resignation of the Chief Election Commissioner (CEC), Gyanesh Kumar, due to “irregularities” associated with the Special Intensive Revision (SIR) of electoral rolls. Khan was joined by his partner actor, Lekha Washington, as well as his cousin, Zayn Marie Khan.

After the three were detained by the Mumbai Police and later released from custody, hundreds of demonstrators were also reported to have been detained during the event.

“I don’t have demands. I am here as a citizen, as a person who lives in this city. I am here to see why freedom of movement is being restricted. Why are people’s voices being suppressed? That is why I am here,” the actor said in the video widely circulated on social media.

After approaching the police, Somaiya questioned whether Khan’s participation in the demonstration had contravened any rules that applied to foreign nationals.

After that, the matter was handed over to the FRRO. Thereby issuing this notice for him leaving out of India on or before October 28th.

What Exactly Did BJP Leader Kirit Somaiya Allege?

He asked why a US Citizen (Holding an OCI Card) Participated in This Political Protest? And further he demanded action against the Actor for his participation in this Demonstration.

Reports indicate that Somaiya too requested for a Look Out Circular (LOC) regarding Khan during this examination. As per the report an LOC is usually issued with a view to informing authorities about the movement of such a person provided there are certain legal processes.

“I had sought a report on how long Imran Khan had been a US citizen,” Somaiya said, adding that he was grateful to the authorities for taking action. It must however be noted that what has been mentioned in the complain can’t necessarily be seen as proof of a legal violation.

Can OCI Cardholders Participate in Political Protests in India?

The card allows foreign nationals who are eligible to access some immigration and residency related privileges however, this status doesn’t grant them Indian Citizenship along with all political rights which an Indian citizen enjoys.

Under Article-19 of Indian constitution freedom such as freedom of Speech and peaceful Assembly are granted exclusively to Indian Citizens but Foreign Nationals don’t have that right unless provided by other law.

Also, their activity within India is governed under several applicable laws along with Immigration condition and restriction. Whether any particular protest comes into category violating rule or not would depend upon respective rules & situation of particular Case.

In this regard, there are reports to suggest that the relevant authorities have already commenced proceedings against him for participating in the said demonstration on October 10th.

It should be noted, however, that making such an allegation of wrongdoing is not ground to establishing that one actually did commit a law breaking act.

What Happens Next?

Khan now has until October 28th, 2026 to make a move with respect to this particular development. Subject to how the relevant parties proceed and what terms may ultimately emanate from this notice. As well as whether he chooses to pursue contesting its contents via legally appropriate mechanisms.

Reports indicate that this notice was issued as of October 15; however, there is no indication yet of what will result from this notice or if there will even be any challenge to its legality.

What makes these cases interesting are larger discussions over what privileges OCI holders have versus those who are citizens and how foreign nationals participate in politically sensitive protests.
