Five-judge Constitution bench rules marriages can be dissolved on ground of irretrievable breakdown

The five-judge Constitution bench of the Supreme Court ruled that irretrievable collapse of the marriage is sufficient grounds for dissolution.

On Monday, Supreme Court’s Constitution bench ruled a marriage can be dissolved based on irretrievable collapse without the required waiting period mandated by marital law.

The five-judge Constitution bench of the Supreme Court ruled that irretrievable collapse of the marriage is sufficient grounds for dissolution. The court stated that it has the authority to invoke Article 143 of the Constitution and that the six-month mandatory waiting period for divorce by mutual consent may be waived under certain circumstances.
