IHBAS director tenure: HC asks for Delhi govt’s response on plea

New Delhi, Jan 6 (IANS) The Delhi High Court on Wednesday asked the Arvind Kejriwal-led Delhi government to respond to a petition against the extension of the tenure of Dr Nimesh G. Desai as the chief of Institute of Human Behaviour and Allied Sciences.

A division bench of the high court presided over by Chief Justice D.N. Patel and Justice Jyoti Singh issued notice to the Delhi government, Ministry of Health and Delhi Health Minister Satyendra Jain seeking their response and posted the matter for further hearing on January 29.

The petition filed by Tej Bahadur Singh claimed that the respondents herein have been acting in a most vulnerable and illegal manner and causing a serious prejudice to the public at large and the Institute of Human Behaviour and Allied Sciences.

During the course of hearing, senior advocate Sudhanshu Batra while appearing for the petitioner urged the bench to quash the communications dated October 30 and 31, 2020 for extension of the tenure of N.G. Desai as a Director of the IBHAS for any period.

Singh through his plea had sought direction to relieve Desai from the post of director or any other post as he completed 65 years of age on October 18, 2020 and had retired as per Recruitment Rules.

The respondent without any justification issued e-mail and letter dated October 30 and 31 to make Desai continue as a director even after his retirement, the plea stated.

Meanwhile in a separate matter in September last year, the Delhi High Court was informed by the IHBAS that the recruitment process for filling vacancies of doctors and faculty has been commenced.
