NEET PG Counselling 2021 Live: The NEET PG counselling process will begin on January 12, Union Health Minister Mansukh Mandaviya said today. Scheduled for October, 2021, the counselling process for admission to postgraduate medical courses was postponed twice due to a petition in the Supreme Court challenging the new OBC and EWS reservation policy announced by the central government and the Medical Counselling Committee (MCC).

The Supreme Court special bench of justices- Justice DY Chandrachud and Justice AS Bopanna will pronounce the verdict at 10:30 AM on Friday (January 7). The court will decide whether counseling will start on the criteria of 8 lakh per annum of EWS quota in NEET PG. “NEET PG counselling has to begin in national interest,” the court remarked.

Solicitor General Tushar Mehta says, “The seats in all government colleges were increased to accommodate EWS quota. So this will not harm the chances of general category students as seats are increased. There is a 25% increase in seats,” Live Law reported.

Solicitor General Tushar Mehta for Centre has urged the Apex Court to allow counseling to go on as he says that this demand of resident doctors is bonafide. He further states that the argument can be carried out, but counseling be not held up.

The case was posted today after the Central Government sought an urgent listing in view of the protests by resident doctors against the delay in NEET PG Counselling dates 2021.
The Supreme Court is scheduled to hear the EWS, OBC reservation in connection with the National Eligibility cum Entrance Test postgraduate (NEET PG 2021) counselling delay case today.
While the NEET Counselling 2021 for UG and PG courses have been delayed for the All India Quota for over a month now, the schedule is expected to be announced by today evening, basis the verdict or decision of the apex court in the matter today.
It might be mentioned that the NEET PG Counseling 2021 delay had lead to massive protests by doctors around the country.
Following a request from the Center, the Supreme Court has agreed to hear the plea ahead of its date. One should keep in mind that if Supreme Court accepts Centre’s affidavit and permits, the UG and PG Counseling 2021 schedule would be announced to begin the admissions to undergraduate and postgraduate medical courses.
It is learnt that the matter of NEET admissions will be heard by a Special Bench led by Justice DY Chandrachud. The hearing is expected to begin around 12 noon. An urgent listing was sought by Solicitor General of India Tushar Mehta.

Intensifying the protest called by the Federation of Resident Doctors’ Association (FORDA) over the delay in NEET-PG 2021 counselling, resident doctors of the Centre-run RML, Safdarjung and Lady Hardinge hospitals in Delhi boycotted all routine services in December 2021.
The Resident Doctors’ Association at Ram Manohar Lohia Hospital has warned the administration that its members will withdraw from emergency services if no concrete step is taken by the stakeholders to ensure immediate completion of NEET-PG counselling.
”Due to insensitive response of governing bodies responsible for the delay in NEET-PG, 2021, counselling, we are compelled to boycott all routine services at RML HOSPITAL (OPDs, special clinics, IPDs, Elective OTS) from December 3 till the time our genuine grievances are not fulfilled,” the RDA said.
On December 31, the Federation of Resident Doctors’ Association (FORDA) called off the strike over delay in NEET PG 2021 Counselling considering various factors including patient care.
The Medical Counselling Committee (MCC), the agency that conducts counselling for NEET, has released the detailed schedule for NEET PG counselling 2021 on the official website.
As per the schedule out on the official website mcc.nic.in, MCC will begin conducting NEET PG counselling from January 12 and conclude round 1 on January 17. NEET PG candidates will need to confirm their choices of colleges after registration. This has to be done by January 17. The colleges will verify candidate on January 18-19, followed by seat allotment process on January 2021 and its result announced for candidates on January 22.
For round 2 of NEET PG Counselling 2021, the registration will begin on February 3 and conclude on February 7 while registration for round 3 of PG Counselling will be done from February 24 to February 28.
As per MCC’s earlier announcement, counselling for both UG and PG medical and dental seats will be conducted in four rounds. These are: AIQ round 1, AIQ round 2, AIQ mop-up round and AIQ stray vacancy round.
The National Board of Examinations in Medical Sciences (NBEMS) will release the individual scorecards for the National Eligibility cum Entrance Test Postgraduate (NEET PG) on Sunday, January 9. The candidates can download their individual score card on the official websites — nbe.edu.in and natboard.edu.in.
The official website of the Medical Counselling Committee (MCC) still says "NEET PG Counselling 2021 has been postponed till further orders". However, the MCC is soon expected to announce the NEET PG 2021 Counselling schedule and NEET UG Counselling dates.

Amid the urgency of counselling, petitioners are demanding that the newly introduced EWS and OBC quota should not be put into place this year and its implementation could be postponed. The govt had earlier this year introduced 27% reservation for OBC and 10% for EWS candidates in AIQ quota.
Advocate Wilson pointed out that the centre's notification on OBC reservation came after the Madras High Court judgement.
"What is this selective challenge to the reservation? We got reservation after the Madras HC judgement. We have filed judgement of Madras HC which held that when Central Educational Institutions are granting reservation, there would be no harm in states granting reservation to too." he said. (Live Law)

Now in the Pandey committee report, you say EWS is a stricter criteria.” “One area where we need to explain is, today's income tax limit is 2.5 lakhs. Up to 5 lakhs, you don't have to pay any tax because you get a rebate. So no income tax effectively till 5 lakhs,” Justice Chandrachud says, as per Live Law report.
Justice Chandrachud asks, “If residential asset criteria is burdensome, why not exclude it this year?”. Solicitor General says that if the criteria is excluded this year, people who did not apply earlier may want to apply, and it will have a cascading effect, as per Live Law.

But in this 5-8 lakh limit, should we defer to the committee?” Justice Chandrachud asked.
"Income here is family income. If there are 3 members in the fam earning 3 lakhs per year their income would be 9 lakhs and they would not come under EWS .This would be more severe if there is 5 lakhs limit. What they say is if they don't want under exclusion they also don't want over inclusion," the Solicitor General said. (Live Law)
"...ultimately we may go into all kinds of statistics but ultimately what convinces the court is the common sense argument. Whether Rs 8akh from common sense point of view be correct- Rs 8 lakh means Rs 70,000 a month. We are not finding out who is poor. The word used is economically weaker," Solicitor General Tushar Mehta said.
The petitioners have demanded that the counselling process should be held without giving effect to July 29 government order introducing OBC and EWS quota.

The centre had last week filed an affidavit in the Supreme Court of India regarding EWS (Economically Weaker Section) reservation in UG and PG medical seats. The centre in the affidavit said the criteria for EWS reservation will remain the same for this academic year and the new policy will come into force next year.
