Triple talaq unconstitutional: Allahabad HC

The Allahabad High Court on Thursday declared triple talaq as unconstitutional and said that it violates the rights of Muslim women.

In an indirect reference to All India Muslim Personal Law Board, the court said “ no Personal Law Board is above the Constitution.”

The Bharatiya Muslim Mahila Andolan (BMMA) has started a petition to abolish the practice of triple talaq and termed it “un-Quranic”.

The petition was sent to High Court by Shayara Bano, a woman who had been divorced by her husband through email.

Calling the observation as a big victory for women, Bano encouraged more women to fight for their rights and demand gender equality.

Reacting to the judgment, Union Minister M Venkaiah Naidu said “Constitution is supreme and above religion. Allahabad Court’s decision should be hailed.”

Muslim Personal Law Board member kamal Farooqi said he does not hold the court’s decision with much regard and said that the board will challenge the statement in Supreme Court.
