Two UP women, in love for 6 years, marry after divorcing their husbands

Supreme Court of India, on 6th September 2018, decriminalised homosexuality by declaring section 377 of the Indian Penal Code as unconstitutional. However, there is no recognition of same-sex marriage or civil partnership by any law in India.

On Saturday, in Bundelkhand region of Uttar Pradesh, two women aged 24 and 26 tied the knot in a simple temple. These two women were in love with each other for the past 6 years, when they were in the same college. But they had to drop out in the mid-session as they were forced to marry two other people after their family came to know about their relationship.

They both got married to their respective husbands after 6 months of their drop out from college. Later they divorced their husbands and struggled a lot to live again together.

They were forced to marry two other people, on which they said, “We were married off six months after leaving college, but could not forget each other. We divorced our husbands and fought a legal battle to stay together again.”

They exchanged vows before their lawyer and friends but the marriage registrar refused to recognize the marriage. Their lawyer said he would challenge the registrar’s decision in the court. “The women are within their legal rights to stay together,” he said.

“Registrar RK Pal has refused to register the marriage on the ground that there was no government order on same-sex marriage,” said Daya Shankar Tiwari, the lawyer of the two women.

RK Pal, who retired from service on Monday, said: “How could I have registered the marriage when there is no such provision? Same-sex marriage is not allowed. We don’t even have an online proforma for it.”

However, the two women had not lost hope and one of them said, “Our lawyer has told us that since the Supreme Court has done away with Section 377, we can stay together. No one can trouble us. We have been living together as a couple for some time now.”

The women refused to share any details about their divorce but they made it clear that they would not claim their marital properties.
