A Muslim woman took to the Shariyat to divorce her husband after being abused by him and his family over the exchange of dowry. The incident came at a time when the petitions are being heard over the practice of Triple talaq in apex court. This is a first-of-its-kind incident in the community.

The couple has been wedded for over six years now. The woman was mistreated by her husband and in-laws due to dowry. Besides, the birth of her daughter increased the conflict. She was beaten up and abandoned by her husband.

“My husband had no affection for me or my daughter. He did not care for our living. I used to get beaten up regularly. Unable to bear this, I came back to my parents and have now decided to go by the Shariyat and give him talaq,” the victim said, reports Business Standard.

Her husband did not even enquire about her or their daughter after she moved to her maternal home, she said. She then approached the court for justice, demanding provisions for compensatory expenses for her and daughter. Besides, she wanted valuables given as dowry to be seized from her in-laws and given back to her. She also demands punishment for mistreatment she faced.

Clarifying the customs of the Shariyat, a cleric stated that if a man is not able to fend for his wife and family then his wife is permitted to part ways.
