Article 370 scrapped: What it brings for you in Jammu-Kashmir?

Explained: How Kashmir became a part of India?

Bharatiya Janata Party-led government on Monday announced the abolition of  Article 370 and 35A of the Indian Constitution which granted special status to Jammu and Kashmir. Moreover, it was announced that Jammu and Kashmir would now be a Union Territory (UT) with a Legislative Assembly while Ladakh would be a UT without a Legislative Assembly.

The provisions under Article 370 and 35A assured that people of J&K would draft their own constitution through their own constituent Assembly. Further, except for defence, foreign affairs and communications, Parliament would need the state government’s concurrence for applying all other laws to J&K. In other words, the provisions of the Constitution which are applicable to other states are not applicable to the state.

Article 35A, on the other hand, gave Jammu and Kashmir Legislature the authority to define and decide which persons qualified as the permanent residents of the state and who had special rights and privileges when it comes to employment, property, etc.

With the two articles gone, Kashmir is now like any other part of India.

With this, one of the biggest questions that come forth is whether an individual can buy property in the Union Territory of Jammu and Kashmir?

As it stands now, the discriminatory provisions that deprived the non-Jammu and Kashmir citizens of the right to buy property in the state stand scrapped. Other Indian citizens can now buy any kind of property in Jammu and Kashmir.

The move also means that if a woman decides to marry an individual who is not from Jammu and Kashmir, she will still get her right to property.

Moreover, the displaced Kashmiri Pandits can now realise the dream of returning to their homeland and settle down there, buying houses and shops. It is not just these two, any Indian is now entitled to buy land in J&K.
