Bhima Koregaon Raids: Supreme Court orders house arrest for 5 accused

Bhima Koregaon Raids: Supreme Court orders house arrest for 5 arrested activists

The Supreme Court ordered only house arrest till the next hearing of the five people arrested over Bhima Koregaon violence on Tuesday. The Supreme Court will hear the case again on September 06, till then, the five accused is allowed to go back home but will remain under house arrest till September 05. In an another case of Gautam Navlakha that Delhi High Court was hearing parallel to Bhima Koregaon case, the court has put a stay on the transit remand and said that there it is not appropriate to proceed forward with the order.

Justice DY Chandrachud of the Supreme Court also said that “dissent is the safety valve of democracy, if you don’t allow safety valve pressure cooker will burst.”

Dr AM Sighvi had argued that the larger issue is the chilling effect merely because one does not agree with the government and had demanded a stay in the order stating, “All our liberties will be jeopardised.”

ASG Tushar Mehta questions locus in very strong words, and said people with no connection to case are before Supreme Court. This is a larger issue of Article 21. Even the FIR has no mention of the arrested people. “These people not alleged to be part of any meeting,” said Singhvi.

ASG Lekhi argues that it was not for the CMM who passed the transit order of Gautam Navlakha to examine the merits of the case as there is a limited scope for scrutiny, what is required is a prima facie satisfaction. She also said that the documents were translated orally for the CMM at the time of Gautam Navlakha ‘s transit remand application.
