Delhi High Court Raises Income Limit for EWS School Admissions to Rs 2.5 Lakh

Acting Chief Justice Manmohan and Justice Manmeet Pritam Singh Arora have changed the single judge's order to increase the income limit from Rs 1 lakh to Rs 5 lakh.

For admission to Delhi schools under the economically weaker section (EWS), the Delhi High Court has revised the annual income threshold. Acting Chief Justice Manmohan and Justice Manmeet Pritam Singh Arora have changed the single judge’s order to increase the income limit from Rs 1 lakh to Rs 5 lakh.

The division bench has modified the EWS annual income limit to Rs 1 lakh to Rs 2.5 lakh till further orders. After hearing the Directorate of Education Delhi’s petition, the bench ruled that “there shall be a stay on the directions in paragraph 119 of the impugned judgment until further orders,” according to Live Law.

When the high court heard a case in December last year in which a man had falsified birth and income certificates to obtain his son’s admission to Sanskriti School under the EWS category, the high court decided to increase the income limit to Rs 5 lakh. As a result, the court allowed the student to continue his studies under the general category.

Until the 2011 reservation scheme is amended, the decision will be applicable. According to the Delhi School Education (Free Seats for Students belonging to Economically Weaker Sections and Disadvantaged Groups) Order, 2011, Delhi schools are required to offer at least 25 percent of the student population in Class 1 to students belonging to the EWS category. According to the Right to Education Act, such students should receive free and compulsory elementary education.

According to the court, the minimum wage of an unskilled worker in Delhi is Rs 17,494 per month, and it was illogical to assume that the annual income will be less than Rs 1 lakh.
