Despite SC’s verdict, Fatima Suraiya of Jharkhand divorced through ‘unconstitutional’ Triple Talaq

Just a day after a constitution bench of the Supreme Court held that the practice of instant Triple Talaq is unconstitutional in a landmark judgment, a woman named, Fatima Suraiya from Barkagaon in Jharkhand’s Hazaribagh district was thrown out of her house after being uttered Talaq thrice by her husband.

SC on Tuesday held that the practice of Triple Talaq is unconstitutional and violative of Articles 14 and 15. Fatma Suraiya, a resident of Barkagaon Police Station area, was divorced by her husband, Kaifi Alam using the same practice on Wednesday.

Just before uttering Talaq thrice, both husband and wife had eaten dinner together. After having food, Kaifi called her on bed and divorced her saying, Talaq thrice. He said that now he cannot stay with her as he divorced her and according to Shariah now it’s impossible to be with her.

Fatima, who was homeless after given divorce by her husband instantly, informed her relatives about the situation. Initially, attempts were made to resolve the matter inside the community. But when they failed, she lodged a written complaint in Barkagaon police station.

According to Fatima, her husband is having an affair with another girl with whom he wants to marry and that is why he has divorced her.

Fatima Suraiya said the Badam Committee has taken the matter into consideration but asked for 20 days time to make decision. By this time, her husband would have married to that girl. So, she along with her relative decided to approach the police. “With the help of my family, I reached Barkagaon police station and called for justice. I believe in law and government, I will definitely get justice,” Fatima told Newscode Jharkhand.
