National Freedom to Marry Day 2024 (US) History, FAQs, Dates, Activities, and Facts About Same-Sex Marriage

National Freedom to Marry Day 2024 (US): On February 12, the freedom to marry an individual of the same sex is commemorated as National Freedom to Marry Day. This unofficial holiday has advocated for the LGBTQ community’s equal rights to marriage and affection since 1999. Although significant progress has been made, the matter of normalizing same-sex marriage remains unresolved. Despite an increasing number of nations permitting a form of matrimonial union that allows for the union of individuals of the same sex, it should be entirely permissible for all LGBTQ couples to enter into a perfect marriage.

National Freedom to Marry Day History

National Freedom to Marry Day has been observed annually on February 12 since 1999 to encourage same-sex marriage. The inception of this holiday was the brainchild of Lambda Legal, a homosexual rights advocacy law firm based in Washington, D.C.

However, long before the inception of this holiday, the struggle for the right to marry individuals of the same sex had persisted. Since more than two decades ago, Evan Wolfson, the progenitor of the organization Freedom to Marry, has been an ardent supporter of the legalization of same-sex marriage. A paper he authored in 1983 while a student at Harvard Law School is presently regarded as the foundational document for the Freedom to Marry movement.

National Freedom to Marry Day was most effectively observed in 2004,, when the City and County of San Francisco, at the behest of Mayor Gavin Newsom, issued marriage licenses to same-sex couples. The clerk’s office was instructed to initiate the required modifications to the “forms and documents used to apply for and issue marriage licenses […] to provide [them] in a nondiscriminatory manner” on February 10.

Since National Freedom to Marry Day occurs two days before Valentine’s Day, numerous LGBTQ individuals exchange vows on that day to commemorate their union. To represent “tying the knot,” knots are tied around trees, signs, and virtually any other object.

Describe DOMA.

DOMA (the Defense of Marriage Act) permits states to deny recognition of same-sex marriages recognized under the laws of other states and defines marriage for federal purposes as the union of one man and one woman. It began to face difficulties in the early 2010s.

Why did Obergefell v. Hodges occur?

Certain provisions of DOMA remained unaltered in 2015, such as Section 2, which authorized territories and states to deny recognition of the unions of same-sex couples from other states. Multiple groups of same-sex couples filed lawsuits against their respective states over prohibitions on same-sex marriages and refusals to recognize such unions conducted in other jurisdictions.
