Triple Talaq is oppressive and anti-human: Arif Mohammad Khan

Amidst the ongoing debates and discussions on triple talaq, former cabinet minister Arif Mohammad Khan delivering a Public Lecture on Triple Talaq and Uniform Civil Code (UCC) said that calling the UCC is a constitutional obligation of the state and part of the directive principle of the Constitution.

Addressing a gathering at the Nehru Memorial Museum and Library, he added that he cannot comment on UCC till the time Government brings in a Draft. “UCC and Triple Talaq are two different issues. Let’s not confuse a constitutional issue with the anti-human aspect of triple talaq.” he said.
“Triple talaq is oppressive and anti-human”, he added.

Notably, Khan has always supported reformation within Muslims. He resigned from the position of Minister of State protesting against Rajiv Gandhi government’s stand on Shah Bano case in 1986. He defended Supreme Court judgment on Shah Bano case in Parliament. Earlier, Khan has opposed triple talaq and said that it should be punishable with 3 years in jail. He is actively involved in policy making and Islam reformation. He has written various books and given multiple lectures.

“Muslim Personal Law Board (MPLB) doesn’t object when the right of property of a daughter is taken away. MPLB doesn’t ask for criminal laws of Shariat to be implemented on Muslim criminals”, Khan said.

It is also to be noted that the Allahabad High Court on Tuesday acknowledged that women’ s basic human rights cannot be violated under the shield of a personal law. As per the HC judgment on a case filed by a woman who was allegedly tortured by her husband over dowry and then divorced, triple talaq was termed as a violation of equality. It added that the Muslim men cannot give divorce in this manner as it is against the right of equality.
