Flagstar Fee Settlement: Flagstar Financial used to operate under the New York Community Bank name before a rebrand in 2024. The bank faced a lawsuit that said it charged wrong ATM fees and unfair non-sufficient funds fees. Even though the bank said it did nothing wrong, it still agreed to end the case by paying 1.23 million dollars.

Flagstar Fee Settlement: Who will Receive the Payment?

The lawsuit covers two main groups of customers. The first group includes people who had checking accounts between March 2, 2017 and January 1, 2020. During this time, some people were charged retry fees after their payments bounced because they did not have enough money.

Others were charged overdraft fees linked to checks and electronic payments like online bills and bank transfers. The lawsuit said the bank’s fees did not match what customers believed from the agreements they signed.

The second group covers the time from August 20, 2020 to February 20, 2024. This group includes people who were charged more than one out-of-network ATM fee for just one withdrawal after they first used the ATM to check their balance. The balance inquiry step lets someone see how much money they have or get a small printed receipt.

How much will you Receive?

People who were charged retry or overdraft fees will get money based on how much they were charged in the past. The amount will be different for each person, but everyone will get a fair share of the settlement. People in the second group, who paid the extra ATM fee, will get one payment of 25 dollars.

The payment process is very simple. Current Flagstar customers will get their money added right into their checking accounts. Former customers will get a check in the mail once everything is approved. There is no long process and there is no paperwork. There is no need to search for old records and anybody who matches the rules is already included in the settlement.

People who do not want to join the settlement can still opt out. The deadline to opt out is December 15. This choice is usually made by people who want to try their own legal case instead of joining the group.

A final court hearing is planned for January 13, 2026. Payments will be sent after the court gives the full approval. Until then, customers just have to wait for the final decision.
