Ayodhya Dispute: Supreme Court adjourns Ram Mandir-Babri Masjid case for January 2019; will fix a date

SC adjourns CBI hearing post 'leak' of Verma's response

Ayodhya Verdict: Supreme Court on Monday adjourned the hearing on Ram Mandir-Babri Masjid dispute for January 2019 and would decide on dates for hearing later. A Bench of Chief Justice of India Ranjan Gogoi and Justices Sanjay Kishan Kaul and KM Joseph proceeded to order today that the case will be listed in January 2019 for fixing a date for the hearing.

The top court was scheduled to hear the plea challenging the Allahabad High Court’s 2010 verdict by which the disputed land on the Ram Janmabhoomi-Babri Masjid area in Ayodhya was divided into three parts. However, the question which was considered by that Bench was whether the 1994 judgment of the Supreme Court in Ismail Faruqui v. Union of India should be revisited.

Earlier in 2010, a three-judge Bench comprising former CJI Dipak Misra and Justices Ashok Bhushan and S Abdul Nazeer had heard the issue on Babri Masjid-Ram Janmabhoomi dispute. In a majority verdict of 2:1the bench had decided that it needs to find out the context in which the five-judge bench had delivered the 1994 verdict.

In the Ismail Faruqui judgment, the Supreme Court had held that while offering a prayer or worship is a religious practice, offering prayer at every location where the prayers can be offered would not be an essential or integral part of such religious practice, unless the place has a particular significance for that religion.
