Fact Check: JDU leader Ajay Alok’s claim of 40 AAP MLAs having rape cases against them is wrong

Ajay Alok has targeted the Aam Aadmi Party on Twitter, claiming that 40 out of the 62 newly-elected MLAs of the party are accused of rape. We are investigating his claim.

Aam Aadmi Party won a landslide victory in the recently concluded Delhi Assembly elections 2020. Soon after AAP’s victory, many veteran leaders of various opposition parties, including Prime Minister Narendra Modi, congratulated Arvind Kejriwal and his party, as a common courtesy.

Many other leaders seem to have had different opinions about the Aam Aadmi Party after the win. Dr Ajay Alok the leader of Janata Dal-United (JDU) and being the spokesperson of his party in the past.

Ajay Alok has targeted the Aam Aadmi Party on Twitter, claiming that 40 out of the 62 newly-elected MLAs of the party are accused of rape. We are investigating his claim.

Ajay Alok claims – 40 AAP MLAs accused of rape:

Ajay Alok wrote a tweet on Thursday evening stating, “Chief Minister Arvind Kejriwal, with his support, 40 of the 62 rape accused, has really started new politics.

It needs to be mentioned here that Ajay Alok’s tweet has been retweeted by more than 6 and a half thousand people and liked by more than 19 thousand people.

The reality of JDU leader Ajay Alok’s claim:

To look into his allegations, we have resorted to a report of the Association of Democratic Reforms (ADR) to investigate this claim of Ajay Alok. Let us tell you that ADR is a well-known non-governmental organization working for election reform.

According to the report of the ADR, 37 out of 70 MLAs elected in the Delhi Assembly have serious criminal cases against them. The Association for Democratic Reforms (ADR) gave this information after studying the affidavits of the legislators.

Rape case against 1 MLA:

The ADR study also shows that 43 out of 70 newly appointed MLAs of Delhi are facing criminal cases. Of these 43 MLAs, 37 have reported that serious criminal cases like rape, attempt to murder and crimes against women. 13 of 37 MLAs have declared cases related to crimes against women. Only one of these 13 reports that a rape case is pending against him.

Serious criminal cases against 33 AAP and 4 BJP MLAs:

ADR report also states that 33 out of 62 MLAs of the Aam Aadmi Party have serious criminal cases against them. Four MLAs from the BJP’s have also been booked under strict sections. AAP MLA from Rithala Mohinder Goyal has given information about the registration of a case of Section 376 (rape) of the Indian Penal Code in the election affidavit.

AAP’s Amanatullah Khan, Dinesh Mohania, Prakash, Jarnail Singh and Somnath Bharti have been accused of molesting or harassing women under Section 354 of the Indian Penal Code.

BJP MLA Abhay Verma and Anil Vajpayee were also booked under Section 354.

On the basis of the report of ADR, it can be said that Ajay Alok’s claim is completely misleading and false.
Significantly, the legal cell of the Aam Aadmi Party has also spoken of legal action against Ajay Alok for his tweet.
