Hathras Gangrape Case: District judge, CJM reaches victim's house, High Court hearing on Oct 12

The Supreme Court is taking up a PIL that is seeking a CBI probe into the Hathras alleged gangrape case wherein a 19-year-old Dalit girl was brutually raped and strangled. The rape-accused will be defended by Supreme Court lawyer AP Singh, who defended the convicts in the Nirbhaya rape case. In UP, police have registered 19 FIRs across the state against the Hathras protests, ranging from attempt to trigger caste conflict to sedition.

According to the reports, the district judge of Hathras along with CJM on Tuesday has reached the victim’s house to meet her family members. The High Court hearing has been scheduled for October 12.

Meanwhile, the Uttar Pradesh government on Tuesday filed an affidavit at the Supreme Court on the Hathras case and justified the state police’s decision to cremate the body of the 19-year-old victim in the dead of the night “to avoid large-scale violence” the next morning. The UP government said that the decision was taken based on intelligence input and intelligence input.

Uttar Pradesh Police have also registered an FIR against Bhim Army chief Chandra Shekhar Aazad and 400 others for violating Section 144, which had been imposed in Hathras since Friday. The FIR was filed under multiple sections of the Indian Penal Code and Epidemic Diseases Act, for violation of Section 144 Code of Criminal Procedure in Hathras.

The FIR, registered at Sasni police station, Hathras district on October 4 states that Aazad and his supporters flouted COVID-19 guidelines despite the police team allegedly trying to make him understand that Section 144 had been imposed in the area.

It also says that this led to obstruction of traffic movement on the road, and additional personnel had to be brought to the area to clear the protest site and allow movement of vehicles.
