The state of Kerala has filed a suit under Article 131 of the Constitution of India challenging the validity of the controversial Citizenship Amendment Act 2019. Kerala is the first state to approach SC against this Act.
The Union of India, represented by Secretary, Ministry of Law and Justice is made the defendant in the suit.

For the uninitiated, Article 131 of Constitution gives Supreme Court original jurisdiction in any dispute between Government of India and any State, in so far as the dispute involves “any question (whether of law or fact) on which the existence or extent of a legal right depends”.
Earlier this month Kerala assembly had passed a resolution demanding the repeal of the Citizenship Act. The ruling LDF was supported by Congress-led Opposition alliance UDF.
