‘Love Jihad’ Laws: Supreme Court declines to stay laws which punish marriages based on religious conversion, issues notices to Uttar Pradesh, Uttarakhand

Supreme Court issued notice to Uttar Pradesh and Uttarakhand after hearing a petition challenging the laws brought by the two state governments to check unlawful religious conversions.

The Supreme Court of India on Wednesday declined to stay the provisions of the laws which punish marriages based religious conversions. The top court, however, issued notices on the petitions challenging the laws made by Uttar Pradesh and Uttarakhand. The matter has been posted for four weeks later.

A three-judge bench comprising Chief Justice of India (CJI) SA Bobde, Justices AS Bopanna and V Ramasubramanian also issued notice to the Centre on the petitions filed by Vishal Thakre and social activist Teesta Setalvad’s NGO Citizens for Justice and Peace.

Initially, the bench was not ready to entertain the pleas. Solicitor General Tushar Mehta informed the bench that the matter is already pending in the Allahabad High Court. “The challenge is already pending in High Courts. Why don’t you go there? We are not saying you have a bad case. But you must approach the High Courts in the first instance instead of coming to SC directly”, CJI was quoted as saying by Live Law.

The petitions challenge the constitutional validity of the Uttarakhand Freedom of Religion Act, 2018 and Uttar Pradesh Prohibition of Unlawful Conversion of Religion Ordinance 2020
