But very few spend time thinking about what will happen to those things after they die. In many Indian families, that silence later turns into fights, court cases, and broken ties. Legal experts say a Will is not only for rich people. It can help anyone who owns a flat, land, jewellery, fixed deposits, shares, or mutual funds. Under the Indian Succession Act, a person of sound mind who is not a minor can make a Will, and the Will must be signed and attested by two or more witnesses.

Maharashtra has now made one part of this process much simpler. The state’s Registration and Stamps Department says there are 517 Sub-Registrar offices across Maharashtra, so people can register documents at many places in the state. The official fee table also shows Rs 100 for registration of a Will and Rs 100 for depositing a sealed cover containing a Will. The same fee table lists Rs 100 for opening or withdrawing a sealed cover too.
A recent report also says citizens can register their Will for Rs 100, and that the move removes the need to spend on stamp duty and a lawyer for the basic registration process.
How can the Will be made?
A Will does not need fancy legal words. It can be written by hand or typed on plain paper. The important thing is that it clearly says the person’s full name, age, and address. It should also say who will get the property and who will act as the executor, the person who will carry out the Will after death. Registration is optional under the Registration Act, 1908, but it is allowed and often helps make the document stronger and harder to challenge later.

The document should be signed on every page by the person making it. Two witnesses also have to sign, and they should not be people who will receive benefits under that same Will.

Safer Options for Storing it
Maharashtra also allows a sealed Will to be deposited with the District Registrar for Rs 100.
- The Will stays confidential while the person is alive. It can be changed or taken back later if needed.
- After death, the sealed Will is opened in front of witnesses.
- Even if a Will was never registered during a person’s lifetime, the executor can still approach the authorities later with the death certificate, witness statements, and an affidavit to get the document verified
