“Shocking if true”, SC on arrests under scrapped IT law; seeks government’s response

The Supreme Court on Monday in a strong statement criticized the government for not keeping a check on arrests made under Section 66(A) of the Information and Technology Act.

Despite Supreme Court striking down the Section in 2015 and calling it “unconstitutional” at least 22 people have been prosecuted under it according to a non-profit organization People’s Union for Civil Liberties(PUCL).

The Supreme Court bench of Justice Vineet Saran and R.Nariman said that a strict action will be taken by them and those officials who were responsible in ordering arrests under the scrapped section will be “sent to jail”. The bench also said that it is shocking if true that people were getting arrested under the scrapped section. The top Court has given four weeks to the government to respond.

The IT Act deals with law regarding cybercrime and e-commerce.
