HUF After Karta’s Death: When a Karta dies, a Hindu Undivided Family (HUF) does not come to an end. Under Hindu law, the eldest coparcener usually becomes the new Karta. If that person is not able to do the job or does not want to, another coparcener can take the role with the consent of the family members.
In simple words, the HUF keeps running even after the head of the family is gone. The people who were already part of the HUF do not vanish from it. They stay members, and the family property is handled under the same legal rules as before.

What Happens to the Father’s Share
A very important point is that a person can only make a will for his own share in the HUF property, not for every asset of the whole family. If the Karta had made a will for his share, then that share will go according to the will. He can even leave that share to someone outside the family if he wants.
If there is no will, the law treats it as if a partition happened just before the person died. Then his share is taken out of the HUF and goes to his legal heirs under the Hindu Succession Act, 1956. Section 6 of that Act says the deceased coparcener’s interest is treated as the share that would have been given to him if a partition had happened immediately before death.
That means the father’s part does not stay locked inside the HUF forever. It gets separated first, and then it passes to the legal heirs under succession law. The rest of the HUF still continues with the other members.
What the Tax Law Says
For tax purposes, this kind of breakup is treated as a partial partition. But income tax law does not recognize partial partition for HUFs. Section 171 of the Income-tax Act says a Hindu family assessed as undivided will continue to be treated as a Hindu undivided family, except where a finding of partition is given under that section. Tax law also says partial partitions are not accepted for recognition.

So even if one share gets carved out under Hindu law, the HUF income from the remaining joint property can still keep being taxed in the hands of the HUF until a full partition happens. That is why the legal side and tax side do not always move in the exact same way.
Full Partition After Death
If the family wants a full partition after the Karta’s death, then the HUF can be divided completely as per law. The exact share depends on the family setup and the legal heirs involved. The main point is that the HUF does not disappear just because the Karta is gone. The structure stays alive until a proper full partition is made.
