Muzaffarnagar: UP police lodges FIR against 5-year-old boy under IPC Section 326

Along with others in a group clash, a minor too booked on the charges of physical assault

Whether by mistake or not, the Uttar Pradesh police lodged an FIR against a five-year-old boy under section 326 of the Indian Penal Code which deals with voluntarily causing grievous hurt by dangerous weapons.

As reported by a national tabloid, in a clash between two groups at a Shamli village earlier this month, an argument had emerged between two residents. The minor child was also present at the spot where the fight had taken place. When the complaint of physical assault was lodged, child’s name was also booked.

After realising the mistake, the embarrassed policeman quickly removed the boy’s name this Thursday September 27, from the FIR. This came as the minor’s family had appealed to UP Chief Minister Yogi Adityanath to intervene in the matter.

Superintendent of police (SP), Shamli, Dinesh Kumar, said, “It is serious blunder on the part of the officers. An explanation has been sought from the investigation officer of Kandhla police station, Anoop Kumar, where the FIR was registered, and a few other cops in the matter. Before registering the FIR against the boy, officers should have confirmed his age.”
