NEET PG Counselling LIVE updates: Supreme Court hearing on OBC, EWS reservation

“At the outset, super speciality has no reservation. NEET exam has nothing to do with admission in super speciality.” “Secondly, Article 15 (5) does not distinguish between undergraduation and postgraduation when it says State can have reservations for socially and educationally backward class,” The Solicitor General said, in response to the arguments that there cannot be OBC reservation in PG, Super-Specialty courses. “Pradip Jain judgment says that in super specialty courses there should be no reservations even on the basis of institutional preference. This means, there can be reservation in other course…This sentence implies that you can have valid reservation up to PG level. The last sentence seems to indicate that”, Justice Chandrachud said. When the EWS quota was added, the government had increased the number of seats in all medical colleges by 25 per cent, the SG said.


The Supreme Court will take up again NEET PG counselling case on January 6. The apex court had deferred the same on Wednesday.

While the apex court is considering Rs 8 lakh as the criteria for availing of the newly introduced EWS quota in medical admissions, the petitioners argued that government does not have any study to arrive at the decision.

On Wednesday, during the hearing, Solicitor General Tushar Mehta for Centre had urged the SC to allow counseling to go on as he says that this demand of resident doctors is bonafide. He further states that the argument can be carried out, but counseling be not held up.

However, Union Health Minister had assured doctors that the counselling will begin from January 6. The counselling will not begin till the final decision is arrived at on the reservation policy.

Meanwhile, candidates have started online protests demanding to expedite the hearing in the case.

Intensifying the protest called by the Federation of Resident Doctors’ Association (FORDA) over the delay in NEET-PG 2021 counselling, resident doctors of the Centre-run RML, Safdarjung and Lady Hardinge hospitals in Delhi boycotted all routine services in December 2021.

The Resident Doctors’ Association at Ram Manohar Lohia Hospital has warned the administration that its members will withdraw from emergency services if no concrete step is taken by the stakeholders to ensure immediate completion of NEET-PG counselling.

”Due to insensitive response of governing bodies responsible for the delay in NEET-PG, 2021, counselling, we are compelled to boycott all routine services at RML HOSPITAL (OPDs, special clinics, IPDs, Elective OTS) from December 3 till the time our genuine grievances are not fulfilled,” the RDA said.

On December 31, the Federation of Resident Doctors’ Association (FORDA) called off the strike over delay in NEET PG 2021 Counselling considering various factors including patient care.
