VA Benefits Eligibility: Veterans who are contemplating the transition to Chapter 33 (Post-9/11) benefits can rely on the guidance provided by the Federal U.S. Department of Veterans Affairs (USDVA) to successfully navigate the process.

Veterans undergoing the transition from Chapter 30 to Chapter 33 must be cognizant of the implications for their entitlements. Chapter 33 grants a duration of 36 months of benefits; however, this entitlement will subtract any months that the beneficiary has already used under Chapter 30.

After exhausting their Chapter 30 benefits, veterans can choose to elect Chapter 33, limiting their total entitlement to 48 months, which includes both chapters.

Are Chapters 1606 and 33 applicable?

Veterans who qualify for Chapter 1606 but choose Chapter 33 face a similar situation. Due to use under Chapter 1606, Chapter 33 gives 36 months of benefits but may limit them to 48 months.

When veterans qualify for both Chapter 30 and Chapter 1606, revocation of Chapter 1606 usually adds 12 months to Chapter 33 compensation. Revoking Chapter 30 limits eligibility to the remaining months.

Veterans should consider the cost and consequences of both perks before choosing. Individuals who qualify for Chapter 30 and have served less than 36 months may benefit by maintaining their eligibility, especially if they are called to active service.

Before receiving Chapter 33 compensation, every service “call up” must have occurred after September 10, 2001. Revocation requires GI Bill eligibility.

Since kickers are unique to Chapters 1606 and 30, veterans with kickers must give them up before switching to Chapter 33.
