Bihar Court’s Verdict: Restaurant Fined Rs 3,500 for Failing to Serve Sambar With Masala Dosa

A customer sued the restaurant for failing to serve Sambar, a soup made with lentils, vegetables, and seasonings, alongside the “Special Masala Dosa.” The consumer court observed that the petitioner’s denial of Sambar caused “mental, physical, and economic” suffering.

According to India Today, the incident occurred on August 15, 2022, when Manish Gupta, on his birthday, decided to treat himself to the ‘Special Masala Dosa’ from Namak restaurant. He arrived at the restaurant and ordered a Rs 140 delivery dish.

The attorney was dismayed to discover that there was no Sambar with the Dosa when he returned home. A incensed Gupta returned to the restaurant and inquired about the Sambar’s disappearance. The restaurant proprietor disregarded Gupta’s complaint as unimportant. “Would you like to purchase the entire restaurant for Rs 140?” the restaurant proprietor jeered.

The attorney then served a legal notice on the restaurant. The lack of response prompted him to submit a complaint with the District Consumer Commission.

After eleven months, a division bench of Consumer Commission chairman Ved Prakash Singh and member Varun Kumar noted the petitioner’s “mental, physical, and economic” distress and found the restaurant guilty.

The restaurant was given a Rs 3,500 fine. The sanction consisted of two components: Rs 1,500 for litigation costs and Rs 2,000 for the basic fine.

The restaurant Namak was granted 45 days to settle the fine. The court also ordered the restaurant to pay 8% interest on the fine amount if the payment is not made on time.
